These General Terms and Conditions (GTC) apply to all contracts concluded between Chaker Apartments GmbH, Mittagsweg 43, 26133 Oldenburg, Germany (hereinafter referred to as „Chaker Living“) and Customers for the arrangement and provision of accommodation. Deviating terms and conditions of the Customer shall only apply if Chaker Living has expressly agreed to them in writing.
Chaker Apartments offers customers the opportunity to make inquiries for accommodation (e.g. vacation apartments, rooms for fitters). On the basis of this request, Chaker Apartments searches for suitable accommodation from its own portfolio or from carefully selected partners. The contract for the provision of accommodation is concluded exclusively between the Customer and Chaker Apartments. Chaker Apartments remains the Customer's sole contractual partner.
By sending the request via the contact form, e-mail, WhatsApp or telephone, the Customer submits a binding offer to conclude a contract. A contract is only concluded upon written confirmation by Chaker Apartments. The booking confirmation contains the binding terms of service and payment.
The scope of services is set out in the booking confirmation. Chaker Apartments is also entitled to fulfill the service by providing accommodation from partners. The Customer has no right to be accommodated only in accommodation from its own inventory. Chaker Apartments reserves the right to make minor changes to the facilities and location of the accommodation, provided that they are of equal value
All prices are quoted in euros and include statutory VAT. Payment is made after invoicing and is due within 7 days, unless otherwise agreed. Chaker Apartments may require advance payment for bookings made at short notice. Additional costs (e.g. electricity, water, heating) are included in the agreed price, unless expressly stated otherwise in the booking confirmation.
The Customer may withdraw from the contract at any time. The date of receipt of the declaration of withdrawal by Chaker Apartments shall be decisive. The following cancellation conditions apply: up to 14 days before arrival: free of charge; 13 to 7 days before arrival: 50 % of the total price; from 6 days before arrival or in case of no-show: 100 % of the total price. The customer reserves the right to prove that less damage has been incurred. Chaker Apartments recommends taking out travel cancellation insurance.
The customer undertakes to treat the accommodation with care and to report any damages immediately. The accommodation may only be used by the agreed number of persons. Pets are only allowed with prior agreement. Subletting or transferring the accommodation is not permitted. The customer is liable for all damages caused by them or their fellow travelers.
Chaker Apartments is liable without limitation for damages resulting from injury to life, body or health that are based on an intentional or negligent breach of duty. Chaker Apartments shall only be liable for other damages in the event of gross negligence or intent. Chaker Apartments assumes no liability for the proper provision of services by third parties (partner accommodations). The Customer shall be liable for all damages caused by him or his fellow travelers.
Chaker Apartments processes the customer's personal data exclusively in accordance with the statutory provisions of the GDPR. Details can be found in the privacy policy on the website.
German law applies. The place of jurisdiction is Oldenburg, provided the customer is a merchant, a legal entity under public law, or a special fund under public law. Should any provision of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
